Q.  Is it true that under the new bankruptcy law, I will be forced to repay my debts?

Q.  I was sued and a judgment was obtained against me. The judgment creditor recorded an abstract of judgment lien on my home. Can this be removed?

A.  In most instances it can be at least partially removed. There are lien avoidance procedures available under the bankruptcy laws which allow for the removal of many liens.

Q.  Can a bankruptcy stop a lawsuit?

A.  The filing stops most legal proceedings against you including wage garnishments.

Q.   Can you stop my creditors from garnishing my wages?

A.   Yes. Garnishments can be terminated immediately when your bankruptcy petition is filed with the Court.

Q.   Can you stop my home from being foreclosed?

A.   Yes. Chapter 7 can be used to temporarily stop foreclosure activity against your real property. Chapter 13 can also be utilized to pay back your mortgage arrearages as well as arrearages on property taxes and homeowners association dues.
